General Terms and Conditions
Terms for orders placed through the Terra di Gaia online shop.
This is a courtesy translation. The legally binding version is the German one.
§ 1 Scope
These General Terms and Conditions apply to all orders placed by consumers and businesses through the online shop of Terra Di Gaia GmbH (hereinafter the “Seller”).
§ 2 Contracting party, conclusion of contract
The purchase contract is concluded with Terra Di Gaia GmbH. The presentation of the products in the online shop does not constitute a legally binding offer but an invitation to order. By submitting your order via the “Checkout” button and completing the payment process, you make a binding offer. The contract is concluded upon our order confirmation by email.
§ 3 Prices and shipping costs
All prices are inclusive of statutory VAT. Shipping costs may apply in addition to the stated prices; these are shown separately during the order process. For details see Shipping & Payment.
§ 4 Limited edition
The MMXXVI vintage is limited to 500 bottles. The goods are in stock and are shipped after receipt of payment.
§ 5 Payment
Payment is made via the payment service provider Stripe. Available payment methods are shown during the order process. The purchase price is due for payment upon conclusion of the contract.
§ 6 Delivery
Delivery takes place within Germany, Austria and Switzerland. We ship within 2–4 business days after receipt of payment.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Details are governed by our Right of Withdrawal notice.
§ 8 Retention of title
The goods remain our property until full payment has been made.
§ 9 Warranty
The statutory liability for defects applies.
§ 10 Final provisions
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Should individual provisions be invalid, the remainder of the contract shall remain effective.
